The person summoned was David Lott, who appeared by a Solicitor, and informed the Magistrate that the business belonged to his wife, and that, consequently, the wrong person had been summoned. The City Solicitors pointed out that the Inspector had inquired of the man in charge of the barrow who was the proprietor of the business., and had been told that it was David Lott. The Magistrate declined to allow the Defendant's Solicitor costs.
