Result of Service of Notices.
(a) Legal proceedings.
As a result of non-compliance with abatement notices legal
proceedings were started in twenty-seven cases. In thirteen of these
cases nuisance orders were made and in the remaining fourteen the
summonses were withdrawn as the work was completed. Fines
amounting to £18 were imposed, and the costs awarded amounted to
£29 lls. 6d.
One application was made to the Court to recover the cost
of a dustbin supplied by the Corporation in default under Section 75
of the Public Health Act, 1936. Three applications were made to
recover the expenses incurred by the Corporation in abating statutory
nuisances in respect of which nuisance orders had been made by the
Court but which had not been complied with by the owners. The
costs awarded amounted to £10 5s. 6d.
(b) Work carried out in default.
Seven dustbins were supplied by the Corporation in the default of
the owners.
In six cases where nuisance orders had been made by the
Court, but not complied with by the owners, the Corporation executed
the necessary work to abate the nuisances. Four of these cases
were Nos. 1, 3, 5 and 7, Caroline Road, where extensive works were
still being carried out at the end of the year, at a total cost of
£1,080 9s. Id.
In one other case work was executed by the Corporation in
default under Section 45 of the Public Health Act, 1936.
