These samples were taken at Victoria Station in course of delivery from two churns consigned to Williams Creameries, Ltd., by the same farmer. Two summonses were issued, and the usual evidence was given for the prosecution. The inspector having stated that the chums arrived unsealed and with one label loose on the top of one of the churns, the defendant gave evidence and called two of his employees to prove that the churns were sealed on the morning they left him, that labels were attached to each, and that such labels could not get loose without being cut, the suggestion apparently being that the water was added by the railway officials. The City Solicitor pointed out to the Magistrate (Mr. Horace Smith) that this was no defence, but he dismissed both the summonses, stating that he did not consider the evidence for the prosecution sufficient. The Magistrate did not say in what respect the evidence was insufficient.
