Public Health (London) Act. 1936
Nuisances
During the year 266 summonses were issued for various
nuisances under the Public Health (London) Act, 1936. In
63 cases abatement orders were secured; fines amounting to
£61. 7s. Od. were imposed and £94. 10s. Od. costs were awarded
to the Council. In 78 cases the summonses were withdrawn, the
nuisance having been abated by the owners prior to the Court
hearings. In 123 cases the summonses were adjourned as the
necessary works were in progress of being carried out by the
owners. In the remaining two cases the summonses were dismissed
and costs against the Council amounting to £5. 5s. Od. were
awarded.
Twenty-eight prosecutions were undertaken for failure to
comply with Justices Orders to abate statutory nuisances. In 20
caeas fines amounting to £321. 10s. 6d. were imposed and costs
amounting to £12. 12s. Od. were awarded to the Council. In one
case the Justices varied the abatement order by making a
closing order prohibiting the premises to be used for human
habitation. The remaining 7 cases were withdrawn as the
necessary works had been carried out.
Food and Drugs Act. 1938
Three prosecutions under this Act were instituted during
the year. In one case the offence was under Section 13 of the
Act, and related to the unsatisfactory condition of a fish shop.
The defendant was fined £10 and costs of £3. 3s. Od. were
awarded to the Council. In the second case the offence complained
of was under Section 3 of the Act relating to an unsatisfactory
sample of vinegar. The summons was dismissed and costs against
the Council amounting to £70. 3s. 8d. were awarded to the
defendant. The third case (under Section 9) was in respect
of unfit bread, and the defendant was fined £5 and costs of
£2. 2s. Od. were awarded to the Council,
Milk and Dairies Regulations. 1949
One prosecution under these Regulations was instituted in
respect of the alleged dirty condition of a milk bottle. The
summons was dismissed on a technical point, and costs against
the Council amounting to £2. 2s. Od. were awarded to the
defendants.
Pharmacy and Poisons Act. 1933
Two prosecutions under Section 18 were instituted in
respect of the sale of preparations containing poison, not
labelled in the prescribed manner. Convictions were obtained
in both cases and fines amounting to £6. 6s. Od. were imposed
and £8. 3s. 0d. costs were awarded to the Council.

Pour summonses were issued under this byelaw, and in
all cases convictions were obtained and fines totalling £2
were imposed.
