Sample No. 18.—In this case it was found that milk was
adulterated before reaching retailer. A sample was taken in course of
delivery by Middlesex County Council, who took action against
Farmer.
Sample No 191.—In this case defendant appealed at Clerkenwell
Sessions. The appeal was upheld, but no costs allowed.
Warranty Defence.
The Borough Council in October once again re-affirmed its opinion
in relation to the " Warranty " defence on receipt of a letter from the
Battersea Borough Council. The Member of Parliament for Hampstead
was asked to support the suggested endeavour to amend the
anomalous position at present obtaining. As was recently pointed out
by a Metropolitan Police Court magistrate, the " Warranty" defence
constitutes a difficulty in securing a good supply of pure milk, because,
as the law now stands, analysts may analyse and Borough Councils
may prosecute, but no good can or will be done until the obvious
remedies are applied, the first being the abolition of the defence of
warranty altogether, making the retailer liable and letting him seek
his remedy against his vendor and the railway company.
This Rorough Council as long ago as 1904 called the attention of the
Local Government Board and the Board of Agriculture to the difficult
and anomalous position of local authorities in administering the Sale of
Food and Drugs Acts, owing to the use, or abuse, of warranties, and
