REPORT OF MEDICAL OFFICER OF HEALTH.
On the Purveyors of Milk in the Borough of Hackney and Section 5
of the London County Council (General Powers) Act,
1908.
To the Chairman and Members
of the Public Health Committee.
Gentlemen,
By section 5 (1) of the London County Council (General Powers)
Act, 1908, it is provided that any Sanitary Authority may remove
from their Register of Cowkeepers, Dairymen or Purveyors of
Milk, or may refuse to enter upon such register, the name of any
person carrying on the trade of dairyman or purveyor of milk upon
premises which are in the opinion of the Sanitary Authority unsuitable
for the sale of milk therein. By section 5 (2) provision is
made for appeal to a Court of Summary Jurisdiction by any person
aggrieved by any decision of a Sanitary Authority under the
provisions of this Section, and the court may make an order on the
Sanitary Authority requiring such Authority to enter upon or
restore the name of such to the Register.
In order that the Public Health Committee may be in a position
to consider the advisability of applying the above section to the
dairyman and purveyors of milk in the Borough of Hackney, I
have had an inspection made of the premises where these trades
are carried on in the Borough, and I beg herewith to report upon
the same. But before considering the suitability of premises in
relation to the milk trade, it is necessary to fix some standard of
suitability or fix some principles by which the Committee may be
guided when considering the question of removal of names from the
Register.
