In 3 cases proceedings have been taken before the
Magistrate to enforce the execution of works ordered
by the Vestry. In 2 of these cases, the order of the
Vestry to abolish cesspools, and connect water-closets
with the sewer had been neglected. Upon the evidence
of myself and Mr. Kirkham the Inspector, the Magistrate,
Mr. D'Eyncourt, issued his order for the prompt
execution of the necessary works. The 3rd case was a
proceeding under the Nuisance's Removal Act to compel
the owner of ten small tenements in a confined locality
to provide back-windows for the purpose of ventilation.
The defendant, consented to allow judgment to be
entered against him. This decision, asserting as it
does the sufficiency of the powers of the Vestry to
enforce the execution of effective means to ensure
ventilation, is one of great importance. I believe it
will greatly facilitate the extension of much needed
improvements in this direction.
