These Orders also gave local authorities discretionary powers, from time to
time, to make regulations for the following purposes, or any of them, viz.:—
(а) For the inspection of cattle in dairies;
(b) For prescribing and regulating the lighting, cleansing, drainage, and
water supply of dairies and cowsheds, in the occupation of persons
following the trade of cowkeeper or dairyman ;
(c) For securing the cleanliness of milk stores, milkshops, and of milk
vessels used for containing milk for sale by such persons;
(d) For prescribing precautions to be taken by purveyors of milk and
persons selling milk by retail against infection or contamination.
In the City of London the local authority for making regulations as above
is the Corporation of London, and elsewhere in the Metropolis the London
County Council.
Under the London Government Act, 1899, the duty of carrying out the
enforcement of the regulations devolved upon the several Metropolitan
Borough Councils.
From 1885 to 1891 the Central Markets Committee carried out the
administration of the Orders in the City, but in the latter year it was
transferred to the County Purposes Committee, who deputed the Inspectors
of Weights and Measures to carry out the duties.
In my last Annual Report I recommended that this work, which deals
entirely with sanitary questions affecting the distribution of a most
important article of food, and can only be properly dealt with by a sanitary
expert, should be undertaken by the Public Health Department. This course
was agreed to by the Court of Common Council on the 29th May, 1902, and
the transfer to my Department was made on the 18th June following.
Section 28 of the Public Health (London) Act, 1891, also conferred powers
upon the Local Government Board to make Orders and Regulations for
the following purposes:—
(а) For the registration with the Corporation in the City, and the London
County Council elsewhere in the Metropolis, of all persons
carrying on the trade of dairyman;
(b) For the inspection of cattle in dairies, and for prescribing and
regulating the lighting, ventilation, cleansing, drainage and
water supply of dairies;
(c) For securing the cleanliness of milk vessels used for containing milk
for sale;
(d) For prescribing precautions to be taken for protecting milk against
infection and contamination.
