Illegal occupation of house subject to Demolition Order
One summons was issued against a person for allowing the
occupation of a house subject to a Demolition Order. A conviction
was obtained and a fine of £2. 0s. 0d. was imposed, the Council being
awarded £2. 2s. 0d. costs.
Overcrowding
Six summonses were issued in respect of overcrowding of
dwelling houses. In 3 cases convictions were obtained and fines
amounting to £8. 0s. 0d. were imposed and the Council were awarded
£3.13s. 6d. costs. Two summonses were withdrawn before the Court
hearings as the overcrowding had been abated. In the remaining
case the summons was dismissed, but no costs were awarded against the
Council.
FOOD AND DRUGS ACT, 1965
Milk & Dairies (Channel.Islands and South Devon Milk)
Regulations. 1956
In one case proceedings were taken in regard to the sale of
Channel Islands milk deficient in milk fat. The defendant was
fined £3. 0s. 0d. and costs of £3. 3s. Od. were awarded to the Council.
The Preservatives in Food Regulations, 1962
Three summonses were issued during the year in respect of the
unlawful presence of the preservatives in food. In one case a fine of
£2. 0s. 0d. was imposed and costs of £2. 2s. 0d. were awarded to the
Council. The second case was withdrawn and the third case was adjourned
sine die.
False Labelling of Food - Sections 6 and 113
One summons was issued in regard to the false labelling of
food. A fine of £1. 0s. 0d. was imposed and costs of £3. 3s. 0d.
were awarded to the Council.
Offences Tinder Section 2
Five summonses were issued in respect of the sale of food
not of the nature, substance or quality demanded. In 4 cases convictions
were obtained, and fines totalling £15. 0s. 0d. were imposed
and the Council were awarded £12. 12s. 0d. costs. In the remaining
case the summons was withdrawn.
Unfit Food-Section 8
Legal proceedings were taken in respect of unsound chickens
deposited (in a restaurant) for sale for human consumption. At the
hearing the defendants produced evidence that the chickens had been
placed on one side for destruction. The Magistrates felt that there
was a reasonable doubt and dismissed the summons, but did not award
costs against the Council.
Food Hygiene (General) Regulations, 1960
One hundred and forty-nine summonses were taken out against
various defendants for contraventions of these Regulations. The
contraventions included the exposing of food to contamination, failure
to keep food premises and equipment in a clean condition, failure to
provide an adequate supply of wash basins, soap, nail brushes and
towels, depositing refuse unnecessarily in food rooms, failure to
