PUBLIC HEALTH (LONDON) ACT. 1936
Nuisances
During the year 72 summonses were issued for various nuisances
under the Public Health (London) Act, 1936. In 27 cases Abatement Orders
were secured and costs amounting to £25.4s.Od. were awarded to the Council.
In 22 cases the summonses were withdrawn, the nuisances having been abated
prior to the Court hearings. In 23 cases the summonses were adjourned
sine die as the necessary works were being carried out by the defendants.
Nineteen prosecutions were undertaken for failure to comply with
Justices' Orders to abate statutory nuisances. In 10 cases fines totalling
£134. 0s. 0d. were imposed and costs amounting to £15. 4s. 6d. were
awarded to the Council. In 5 cases the summonses were withdrawn as the
work had been completed, and in the remaining 4 cases proceedings were
adjourned sine die as the work was in the process of being carried out.
London County Council (General Powers) Act. 1954 (Section 12)
Three summonses were issued in respect of failure to provide
proper dustbin accommodation. In 2 cases convictions were obtained and
fines amounting to £4. Os. 0d. and £2. 2s. Od. costs were imposed. The
third case was withdrawn as the dustbins had been provided prior to the
Court hearing.
London County Council Drainage Byelaws
Fourteen summonses were issued in respect of contraventions of
these Byelaws, which included failure to deposit plans; failure to give
notice of intention to commence drainage work; failure to carry out or
to maintain drainage work in good condition, etc. Convictions were
obtained in 12 cases and fines totalling £11. 0s. 0d. were imposed with
£5. 5s. Od. costs. In 2 cases summonses were withdrawn as the defendants
had complied with the Byelaws before the Court hearing.
London County Council Water Closet Byelaws
Thirteen summonses were issued against one defendant for
offences under these Byelaws, but were eventually withdrawn as the
contraventions were remedied before the Court hearing.
London County Council (General Powers) Act, 1959 (Section 22)
Three summonses were issued in respect of unlawfully retaining
and using a caravan on vacant land for which a licence was not in force.
Two of the summonses were not served as the defendants left without trace.
In the third case, however, a conviction was obtained and a fine of 20/was
imposed.
HOUSING ACT. 1957
Illegal occupation of closed unfit rooms
Twelve summonses were issued against landlords or tenants in
respect of the illegal occupation of closed rooms. In 9 cases convictions
were obtained and fines totalling £32. Os. Od. were imposed
and costs of £9. 9s. 0d. were awarded to the Council. In two cases
the summonses were dismissed but no costs were awarded against the
Council. The remaining case was adjourned sine die as the defendant
was an inmate of one of H.M. Prisons.
