an article which is made exclusively from pure and wholesome
raw material, is manufactured without nuisance, and is intended
as an article of food, and as such is prepared with special regard
to cleanliness, and whose manufacture is subject to inspection by
public officials, and, as in the case of other foods, it would be
liable to seizure and condemnation. These conditions, in my
opinion, are radically different from those which prevail in the
business of tallow melters as commonly understood and contemplated
by the Statute. I have come to the conclusion, therefore,
and that not without hesitation, that I can draw no distinction
between the premier jus rendered by and for oleo and that
rendered in the digestors. The test, therefore, is whether the
preparation of this article is tallow melting within the Statute, and
turns upon whether it is intended for food, and the fact that on
an isolated occasion the term has been applied to it for technical
purposes does not alter its character. The summons will therefore
be dismissed.
The summons was accordingly dismissed, with fifty guineas
costs, and leave to appeal granted.*
Dairies, Cowsheds, and Milkshops Order. At the commencement
of the year, there were 210 premises on the Register
of Dairies and Milkshops; 17 new applications have been received
during the year and added to the Register, and 17 names have
been taken off, thus leaving a total of 210 premises now registered.
During the year 390 visits of inspection have been paid to these
premises; notices were served upon the occupiers in 12 cases, 10
of which were for dirty premises generally, in 1 case for dirty
milk vessels and utensils, and in 4 instances for general insanitary
conditions.
*i understand that the London County Council have, on further consideration,
decided not to appeal in this case, but to be satisfied with the licensing of this firm as
Fat Melters, which licence they have all along been willing to take out, in accordance
with our request.
