As some doubt existed whether the Vestry could acquire property
other than that actually required to be thrown into the public way
under the compulsory powers of the Act before-mentioned, the opinion
of Mr. Poland, Q.C., was taken on the point. Mr. Poland advised that
the Vestry had no power under Michael Angelo Taylor's Act to acquire
compulsorily any property other than and beyond that which it proposed
to throw into the road and footway, except that where part of a house is
required it may be compelled to take the whole house, power being
given to the Vestry to resell that part of the site which is not required.
The Act also provides that the owner of the house may, if he thinks fit
buy back the land purchased from him which is not required for the
purpose of widening the highway in preference to any other proposed
purchaser.
No further action had been taken in the matter at Lady Day last.
