It was not found necessary to take legal proceedings under this Act, Merchandise
Marks Act,
1926.
In October I received information from a neighbouring County Council
that a firm in the Borough was receiving butter from New Zealand, Australia,
Esthonia, Argentine and Siberia, and blending them, calling these mixtures by
various proprietary names. They stated that the butter was labelled in paper
describing various named brands and packed in boxes which were alleged to
contravene the Merchandise Marks Acts. I caused investigation to be made.
The firm concerned was a reputable one and there was no infringement of the
Act, as each brand was described as " including imported butter."
Unfortunately under the present Order it is only necessary to add to
foreign butter the smallest proportion of Empire butter and there is no obligation
to mark the mixture "foreign." It can have applied to it the mark
" including imported " butter. This is misleading. A better way would be
to mark the butter of the country of origin which supplied the highest percentage
in the blending.
