In Mr. Fortescue's case the land had just been acquired at
the public expense, and Mr. Fortescue can, without payment,
acquire about 104 square feet of the road without any consideration.
The Committee consider it of importance to restrain persons
from taking in comparatively narrow thoroughfares practically a
foot of land on each side of the thoroughfare.
Tour Committee recommend—
That the Judgment of the Court should be printed. That a
copy be sent to each Metropolitan Vestry and District Board, with
a request that the several Boards will join in and support an
application to the London County Council to insert a clause in
their next General Powers Bill to prevent encroachments on the
Highways by building owners, and restoring to the Vestries and
District Boards their powers under the 72 sec. of Michaol
Angelo Taylor's Act.
And that application be made to the London County Council
accordingly.
The Vestry adopted the Report of the Committee. Communications
were accordingly sent to the County Council and to the
District Boards and Vestries. In most instances replies favourable
to the suggestion of the Vestry were received. A Bill to
amend the law relating to buildings in the Metropolis was before
Parliament. A largely attended conference of delegates from
Vestries and District Boards was held at Kensington Vestry
Hall, when amongst other things it was agreed that the alteration
in law suggested by the Vestry ought to be effected by the Bill
before Parliament. The Session terminated before the Bill could
be dealt with.
