vinegar, it was claimed by the makers that its addition prevented
the growth of "mother," which is a micro-organic growth apt to
appear after prolonged storage. In the absence of any statutory
ruling in the matter no action was taken.
Cocoa—No. 58.
This was a sample containing only 11½ per cent. of fat, whereas
cocoa ordinarily sold in this country contains at least 20 per cent.
Proceedings were instituted under Section 3 (1) of the Food and Drugs
Act, 1938, when the vendors successfully pleaded a warranty. The
commodity and the warranty were both several years old, and under
Section 80 (1) (b) proceedings against the warrantor must be taken
within 12 months. In the circumstances, although a prima facie
offence had been committed, no action likely to succeed could be
taken against the manufacturer, and the case had to be withdrawn.
It would seem reasonable that if a manufacturer can claim immunity
if his warranty is more than a year old, the vendor should not be
permitted to reply upon a warranty if his goods have been kept in
stock longer than that period.
Stuffing—No. 120, Thyme and Parsley.
No. 141, Pork and Duck.
In both these samples the labels did not specify the ingredients
as required by the Labelling of Food (No. 2) Order, 1944, and warnings
were given to the retailers.
