Abatement Notices: Legal Proceedings
The number of complaints received by the department does not diminish and as the majority
relate to house repairs, abatement notices are served when necessary.
Although a large volume of work is done upon the service of preliminary notices, statutory
notices are served when the necessity arises.
During the year summonses were issued in 13 instances for non-compliance with abatement
notices. In 11 of these the work was carried out before the hearing and proceedings were withdrawn
on payment of the Corporation's costs. Orders were made in respect of the remaining
seven cases; one defendant failed to comply with the order and a penalty of £5 was imposed
with £2.2s.0d. costs.
Noise Nuisance
During 1960 the Noise Abatement Bill became law with the passing of the Act, which came
into operation on 27th November, 1960. It gives wider powers to Local Authorities to take action
for noise and vibration by dealing with it as a statutory nuisance under the Public Health Act.
In addition three or more persons may make a complaint to a magistrate.
Part of the Act regulates the use of loudspeakers in streets, confining their use within
limited hours and for limited purposes only. The Act does not apply to aircraft.
The Council became a member of the new Noise Abatement Society which was formed to
serve the useful purpose of keeping the need for noise abatement actively before the public.
Cleansing and Disinfecting
The new cleansing and disinfecting station sited at the Refuse Disposal Works has been
fully operative during the year. It has proved to be more efficient and more flexible in meeting
requirements made at short notice.
