It will be seen from the tabulated statement that the summonses
under the Public Health Act were withdrawn after the
work of complying with the Notices had been carried out and
costs amounting to £7s. 6d. paid.
The fines imposed under the Shops Act amounted to £36
7s. 6d.
Only one conviction was obtained under the Sale of Food
and Drugs Act. 3 cases were dismissed, 2 being against one
defendant, for selling milk deficient in milk fat, who pleaded warranty
and called evidence which satisfied the Court that the milk
was sold in the same condition as when received. A summons
was applied for and granted against the warrantor, which also
failed. In the fifth case (hot milk) legal difficulties arose and
it was decided not to proceed. Recent legislation has made
material alteration in procedure where a warranty is pleaded as
a defence.
