"This section," it is added, in sub-section (2), "shall apply to any factory
which is not subject to the provisions of the Factory and Workshop
Acts (of 1878, 1883, and 1891), and to any workplace, in like manner
as it applies to a workshop."
The following section (26) of the Public Health (London) Act,
1891, deals exclusively with bakehouses. It enacts that—
"(1) Sections 34, 35, and 81 of the Factory and Workshop Act, 1878, and
sections 15 and 16 of the Factory and Workshop Act, 1883 (which
relate to cleanliness, ventilation, and other sanitary conditions), shall,
as respects every bakehouse which is a workshop, be enforced by the
Sanitary Authority and they shall be the Local Authority
within the meaning of those sections."
Sections 34 and 35 of the Factory Act, 1878, above referred to,
make provision with respect to the limewashing, painting or varnishing,
and washing, &c., of the interior of bakehouses, and as to sleeping
places near bakehouses. Section 81 relates to fines for not keeping
any factory or workshop "in conformity with the Act."
Section 15 of the Factory and Workshop Act, 1883, makes
sanitary regulations for new bakehouses; section 16 provides a penalty
for the bakehouse being unfit on sanitary grounds for use as a
bakehouse.
Sub-section (2) of the 26th section of the Public Health (London)
Act, 1891, gives powers of entry to bakehouses, for the purposes
of the section, to the Sanitary Authority and their officers.
Section 3 (2) of the Factory and Workshop Act, 1891, gives
powers of entry, &c., to workshops, &c., generally. It enacts that—
"For the purpose of their duties with respect to workshops (not being
workshops to which the Public Health (London) Act, 1891, applies), a
Sanitary Authority and their officers shall have all such
powers of entry, inspection, taking legal proceedings, or otherwise " as
a Factory Inspector.
Section 4 of the same Act enacts that—
"Every workshop and every workplace shall be kept
free from effluvia arising from any drain, water-closet urinal,
or other nuisance, and unless so kept shall be deemed to be a nuisance
liable to be dealt with summarily under the law relating to public
health."
