Miscellaneous
amendments.
There are a number of other miscellaneous amendments, which
with the exception of that in section 42, it is not necessary to bring
under your notice as the sanitary authority.
List of employes to
be sent to Inspector
twice in each year.
Section 42 is as follows :—
"Every occupier of a factory or workshop to whom section
27 of the Act, 1891, for the time being applies, and
every contractor employed by any such occupier in the
business of the factory or workshop shall, on or
before the first day of March and the first day of
September in each year, send to the inspector for the
district in which the factory or workshop is situate,
a list showing the names of all persons directly
employed by him, either as workmen or as contractors
in the business of the factory or workshop, outside
the factory or workshop, and the places where they
are employed, and in default of so doing shall be liable
to a fine not exceeding forty shillings.''
This section applies to any place from which any work of
making wearing apparel is given out.
Some of the provisions of this Act are to be enforced by the
sanitary authority, others by the factory inspectors: but there are
a number in which it is not quite clear who is responsible for their
enforcement.
The sanitary authority will, after the 1st of January next be
required to inform the factory inspector of the proceedings taken in
consequence of a notice from him of insanitary conditions in a
workshop or factory, and this must be done within a month. I
take it that it is not a detailed account of the Vestry's action which
is required. In event of the sanitary authority failing to take action
the factory inspector may act and recover from the nanitary
authority, expenses incurred, which are not recovered from any
other person.
Taking into consideration section 6 of this Act, it would be of
service to the sanitary authority if a duplicate of the list which is
required by section 42 to be sent twice a year to the factory inspector
for the district in which the factory or workshop is situate, were
forwarded at the same time to the sanitary authority.
As to what is to be considered a 'reasonable temperature, which
by section 32 it is necessary to maintain in a workshop or factory,
is a question concerning which there must be a good deal of difference
of opinion.
