Legal Proceedings under Public Health Act, Section 94
It was only necessary to deal with one premises by way of legal proceedings
during the year.
In 1959 the Magistrates had granted Orders prohibiting any recurrence of
nuisances caused by the keeping of a large number of cats at the premises and awarded
the Council costs.
Proceedings had to be instituted again during 1960.
On the first occasion 29 charges were made of failing to comply with the Order
to prevent nuisance from the burning of cats' excreta on the kitchen boiler, 2 charges
of failing to comply with Orders prohibiting the recurrence of nuisances in the house
and garage, and application made for an Order to abate a nuisance from a heap of
filth in the garden. The defendant, who was represented by Counsel, pleaded not
guilty to the charges and denied the complaint. The Magistrates convicted on each
charge relating to the burning and imposed fines of 10/- each (total £14. 10. 0.)
