On 30th June, 1902, the occupier of an Underground Bakehouse in Cloth
Fair was informed that if he wished to use his bakehouse as such after the
1st January, 1904, it would be necessary for him to make certain alterations
to the premises in order to obtain the statutory certificate.
Being unwilling to bear the whole of the cost the occupier made application
on the 12th October, 1903, at the Guildhall Justice Room, for relief under
Section 101 (8) of the Factory and Workshop Act, which provides that:—
"Where any place has been let as a bakehouse and the certificate
"required by this section cannot be obtained unless structural
"alterations are made, and the occupier alleges that the whole or
"part of the expenses of the alterations ought to be borne by the
"owner, he may by complaint apply to a Court of Summary Juris"diction,
and that Court may make such order concerning the
"expenses or their apportionment as appears to the Court to be just
"and equitable, under the circumstances, regard being had to the
"terms of any contract between the parties, or in the alternative
"the Court may at the request of the occupier determine the lease."
The Alderman decided that the application was premature, and that he had
no power to deal with the matter until the Corporation had formally notified
the applicant that a certificate would not be issued until the specified improvements
had been carried out. A resolution to this effect was therefore passed
at the next meeting of the Court of Common Council, and the occupier
informed accordingly.
The work required was subsequently done by mutual agreement, the owner
paying one-third of the estimated cost.
