LONDON GOVERNMENT ACT, 1899.
This Act came into force in November, 1900, and the new Metropolitan
Borough Councils had transferred to them certain additional powers and
duties, some of which are of sanitary importance.
By the Second Schedule, Part I., there were transferred the powers under
section twenty-eight of the Public Health (London) Act, 1891, of registering
dairymen; subject to the power of the London County Council to make
Bye-laws, and in case of default to the provisions of the Public Health
(London) Act, 1891, as if the default were a default under that Act.
By the Second Schedule, Part II., there were transferred the powers under
section seventeen to twenty-five of the Metropolis Water Act, 1871, with
respect to regulations of Water Companies. The power to be exercised only
with respect to a Water Company supplying any part of the Borough.
Power under section seven of the Railway and Canal Traffic Act, 1888, to
make or appear in opposition to certain complaints.
Power under section sixty-five of the Local Government Act, 1888, which
section relates to the acquisition of land. The power to be exercised only
when the land is required for the purpose of any of the powers or duties of
the Borough Council.
Power to adopt Part III. of the Housing of the Working Classes Act,
1890. The power to be exercised only within the Borough.
Power to make Bye-laws under section twenty-three of the Municipal
Corporations Act, 1882, as applied by section sixteen of the Local Government
Act, 1888. The Bye-laws to be in force only within the Borough, and
not to be inconsistent with any Bye-laws of the County Council.
Registration of Dairymen.—The Dairies, Cowsheds, and Milkshops' Orders of
1885, 1886, and 1899 require the registration of all purveyors of milk with
the Local Authority, and empower the Local Authority to enforce Regulations
as to cowsheds, dairies, milkstores, milkshops, and milk-vessels.
Regulations of Water Companies.—The Borough Council now exercise within
the Borough, conjointly with the County Council, the powers under Sections
17 to 25 of the Metropolis Water Act, 1871. A summary of the provisions
of these sections has been already set out under the head of" Water Supply."
Railway and Canal Traffic.—The Railway and the Canal Commissioners are
the Authority exercising jurisdiction under this Act, and appeals from the
Board of Trade under the Cheap Trains Act, 1883, for the purpose of
providing a sufficient service of workmen's trains are referable to the Railway
and Canal Commissioners.
Acquisition of Land.—Section 65 of the Local Government Act, 1888, gives
power to the Borough Council to acquire, purchase, take on lease, or exchange
land, and to acquire, hire, erect, and furnish halls, buildings, and offices. The
compulsory purchase of land requires notices to be served and a Local
Government Board Inquiry to be held.
