London County
Council (General
Powers).
36. Part IV. of this Bill contained provisions for the regulation
of lamps, structures, etc., in front of buildings
and proposed to authorise the County Council
to consent to or require the removal of any case,
board, stall, awning, or other thing used for the display of articles
or advertisement which extends beyond the exterior of any building
and beyond the general line, or overhangs the public way. Part V.
proposed to repeal the existing provisions with respect to the
manufacture and sale of ice creams, and contained new provisions,
and provided that proceedings might be taken by the County Council
in case of default by the Sanitary Authorities. Clause 31 would
have required the consent of the County Council to the construction
of subways or passages under streets. Clause 32 extended the provisions
of section 3 of the Metropolis Management (Amendment)
Act, 1890, so as to enable Metropolitan Borough Councils to execute
necessary works of repair to footways as well as to carriageways,
and to recover the expense thereof from the adjoining owners.
This clause was inserted upon the suggestion of this Council.
Clause 33 proposed to amend section 205 of the Metropolis Management
Act, 1855, so as to make employers liable for damage done
by their servants to property belonging to Councils. This Council
presented a petition against the provisions of Part IV., asked for
the substitution of the Borough Councils for the County Council
in clause 31, and approved of the provisions of clauses 32 and 33.
Councillors Cundall and A. D. Robinson, M.A., LL.B., attended
on behalf of this Council, a Conference of representatives of Metropolitan
Borough Councils, at which the following resolutions were
passed, viz.:—
1—That this Conference of representatives of the Metropolitan Borough
Councils emphatically protests against the unnecessary encroachments
upon the powers and duties of the Metropolitan Borough Councils contained
in the London County Council (General Powers) Bill of the present
session of Parliament.
2—That in the opinion of this Conference, Clause 19 (Regulations and control
of certain lamps, structures, etc.), and Clause 20 (Council may require the
removal of cases, boards, etc.) of the Bill are particularly objectionable in so
far as they seek to confer powers on the London County Council at present
exercisable by the Borough Councils with regard to certain projections on
or over the public way, more especially as the matters referred to in
Clause 19 are sufficiently provided for by Section 164 of the London
Building Act, 1894, which empowers the London County Council to make
Bye-laws in respect thereof, and vests the administration of such Bye-laws
in the Borough Councils.
