and were successful in 21; 1 case was withdrawn, owing to the
defendant's business being in liquidation, and 2 were dismissed, 1
owing to the exaggerated difference between the result of analyses of
the Council's analyst and that of the Government analyst, and the other
to the proved statement of the defendant that the milk was as it came
from the cows. (See Samples 351 S. and 725 S.)
Sunday Samples.—98 of the samples of milk were taken on
Sundays during the year; 10 (10'2 per cent.) were found to be
adulterated. {See lists of Prosecutions Nos. 256 S., 325 S., -429 S., 535 S.,
and 324 S. (Separated Milk).)
Samples taken in course of Delivery—-
(a) At Railway Stations.—25 samples of milk were taken on arrival
at Victoria and Charing Cross Railway Stations. Fourteen were reported
of good quality, 5 fair, 5 poor and 1 adulterated:—Fat
abstracted, 15 per cent. The defendant had obtained an analysis of
the sample left with him which was certified to be pure, the Council's
analyst certified a deficiency of 15 per cent, of fat and the Government
analyst certified a deficiency of 24 per cent, of fat. The Magistrate
dismissed the summons partly on the ground of the variation between
the three analyses and partly on the statement of the defendant's
solicitor that the milk was as given by the cows, in proof of which he
tendered his witnesses.
(J) On Delivery at Shops, c&c.—41 samples of milk were taken as it
was being delivered by wholesale firms to retail customers, including
shops, hotels and hospitals. Of these samples, 19 were good, 15 fair,
5 poor, and 2 adulterated (38 per cent, added water and 13 per cent,
fat abstracted). These samples were taken in consequence of previous
samples being found below the limit (including cases where a warranty
defence was set up).
Proceedings were taken against the vendors of the adulterated
samples.—See Nos. 156 K and 328 S. in list of prosecutions.
Refusal to sell Milk.—Three cases of "refusal to sell" milk to the
Inspector occurred during the year. Proceedings were taken in two
instances with the result that one was fined 10s. and 14s. Gd. costs, the
other 20s. and 2s. costs. In the third case a sample was eventually
obtained and found to be genuine, and on the recommendation of the
City Solicitors no further action was taken.
Infringement of Section 9, Sale of Food and Drugs Act, 1899.—
Seven persons were found to be using milk cans and barrows without
