being sections II., X., XI., XII., and XIII., and the penalty provisions
which follow should be re-enacted in modern language.
A section should be inserted to the effect that meal or flour of
wheat, barley, rye, oats, buck-wheat, Indian corn, peas, beans,
rice or potatoes Should be separately stored in properly marked
sacks or bins.
The properly appointed officers of the local authority should
have the right to enter any premises and without purchasing take
any samples of dough or bread, or samples of meal or flour
of any grain from any sacks or bins and submit the same to
the public analyst, and if found to be adulterated, proceedings
should be taken.
The taking of samples in this manner, without purchasing,
would not be a new procedure, as Inspectors have power, for the
purposes of analysis, to take without purchasing samples purporting
to be butter and cheese. Butter, under section 10, Margarine
Act, 1887, 50 and 51 Vict., c. 29, and cheese under Food and
Drugs Amendment Act, 62 and 63 Vict., c. 51, section 5.
The baker should be protected by warranty in a like manner
as the vendor is protected under the Food and Drugs, and
Margarine Acts, and then sections X., XI., XII., of Act 3 Geo.
IV., CVI., would if re-enacted be well met. The warranty would
also apply to section XII., so as to protect those persons who
sell, but do not make bread.
So far as section XII. is also concerned, which enacts that
bread made of mixed meal or flour is to be marked with a large
Roman M, it would be better that when bread is made wholly
or partially of the meal or flour of any other sort of corn or grain
than wheat, or of the meal or flour of any peas or beans, to have
all such bread marked or stamped with the name of its component
parts, so as to be intelligible to the public who do not
know what a large Roman M means.
Potatoes should be added to this section, as these ingredients
are included in 6, 7, Will. 4, c. 37, sec. 10, which is similar to 3
