3. Proposal to issue Certificate of Disrepair.
On receipt of the application (Form I) the dwelling is inspected
in strict relation to the alleged defects. Consequent upon
the report, if the local authority are satisfied that all or some of
the defects ought reasonably to be remedied, they must serve on
the landlord notice Form J. This notice specifies the defects
proposed to be included in the certificate of disrepair which will
not, however, be issued if within 3 weeks from the date of service
the landlord gives to the tenant an undertaking (Form K) to
remedy the defects within 6 months and serves a copy of same on
the local authority. In the event, however, of such an under
taking being given by any landlord designated in Paragraph 5
subsections (a), (b), (c) or (d) (one who has already defaulted in
respect of previous Public Health notices), then the local authority
may refuse to accept the undertaking and issue a certificate of
disrepair, in which case the undertaking shall be deemed never
to have been given.
4. Acceptance of Undertaking or Issue of Certificates of Disrepair.
Where a copy of the undertaking (Form K) is received then,

Following receipt of an application (Form M) from the landlord
for the cancellation of the certificate with the statutory fee of
2/6d., the local authority must serve on the tenant notice Form N.
This notice states that the Council propose to cancel the certificate
of disrepair unless an objection on the ground that all or any of
the defects specified in the certificate remain unremedied is received
within 3 weeks from the date of service.
Where no objection is received this authority accordingly
send to the landlord notice of cancellation of the certificate of
disrepair.
If, however, an objection is received the local authority must
cause an inspection to be made and, if in their opinion, it is not
justified the same action is taken as mentioned in the preceding
paragraph with an additional notice of rejection from this authority
to the tenant. Where they are satisfied that the objection is
