Properties Remaining in Control
Subject to (c) above any privately owned letting with a rateable
value of £40 or less in London remains controlled.
The provisions made for increasing rents vary from l⅓rd to
2⅓rd times the gross value, according to responsibility for repairs
between landlord and tenant. The resultant figures arrived at are
the maximum rents which can be charged exclusive of any additions
for rates, services or improvements. Subject to the foregoing, the
notice of increase may specify more than one date and amount but
the initial increase must not, except in certain cases, take effect
earlier than 3 months nor exceed 7/6d. within 9 months from the
date of service. This limit of 7/6d. is exclusive of any adjustment
in respect of increased rates, services or improvements, to which the
landlord may become entitled. Where, however, any rent is already
above the limit such rent will continue unaffected provided it was
lawfully chargeable under the Rents Acts.
Procedure of Abatement for Disrepair.
The procedure laid down in Part II of the First Schedule is
considerably more involved than any previous legislation and is as
follows :—
1. Service of Form O.
The tenant serves on the landlord a notice (Form G) specify"
ing the defects of the dwelling. The tenant must retain at least
one copy of this notice.
2. Application for certificate of Disrepair.
If, on the expiration of 6 weeks from the date of service of
Form G the defects have neither been remedied nor has the landlord
given an undertaking (Form H) to remedy those defects within
6 months (or such of them as the tenant may agree in writing to
accept as sufficient), the tenant may on Form I apply to the local
authority for a certificate of disrepair enclosing a copy of Form G
and a fee of 2/6d.
Note : If the certificate is granted the tenant is entitled to deduct the
fee from any subsequent payment of rent to the landlord.
