Subsequently the Council obtained a declaration at the County
Court entitling them to a first charge on the property in priority to
any mortgage, &c.
The freeholder of six houses in Longhedge Street brought an
action for possession under Section 30 of the Housing Act, 1925,
against the leaseholder and the Council were joined as defendants
in the suit. The order for possession was made, but was to be
discharged if the works ordered by the Council were certified to be
completed in 28 days. The terms of the Order were complied with.
Appeals.
It is satisfactory to record that during 1931 the right of appeal
by owners against notices served under Section 17 of the Housing
Act, 1930, was not exercised.
Closing Orders.
No Closing Orders were made by the Council during 1931.
Demolition Orders.
No Demolition Orders were made by the Council during 1931.
The Housing Committee, on a report submitted to them,
considered as to making a Demolition Order in respect of a house
in Usk Road.
The Owners, however, gave an undertaking to make the
premises in all respects reasonably fit for habitation. As the work
was carried out to the satisfaction of the Council's Officers a Demolition
Order therefore was not made.
The Committee also had under consideration during the year
seven other houses reported to them as being unfit for habitation
with a view to Demolition Orders being made thereon, but action
in regard to these houses was still pending at the end of the year.*
In May, 1920, the Council made a Closing Order in respect of
No. 7, Darien Road—an empty house—and in due course a Demolition
Order in November, 1920. Having regard to the fact that this
house is one of a terrace and that its removal gave rise to risk of
damage to the adjoining houses the demolition was not proceeded
with.
* Demolition Orders were made in respect of six of these houses on 24th
February, 1932. The owner of the other house gave an undertaking to carry
out the necessary works; a Demolition Order was not, therefore, made.
