bone dealer, but under Sub-Section (6) is enacted that
nothing in this section or in any of the Bye-Laws
made or applied thereunder shall be construed as
imposing upon any person any obligation to alter any
premises which at the passing of the Act were used
for the business aforesaid, consequently this elaborate
section appears to be of no use for all existing trades
and premises and would only apply in the event of
their being rebuilt or renewed.
Section 10 makes it a statutory duty of the Sanitary
Authority to carry out and enforce this part of the Act
and the Bye-Laws made thereunder.
Section 12 gives the usual right of entry to officers
or persons duly authorised to enter premises for the
purpose of enforcing the Act or Bye-Laws made thereunder,
but does not appear to clear up any of the
difficulties or technicalities as to what the power of
entry really means.
Section 13 enables any owner to enter premises for
the purpose of carrying out alterations and requirements
under the Act notwithstanding the provisions
of any lease, under-lease, or agreement, relating to
such premises.
Section 14 applies the general provisions as to
power of entry and penalties for obstruction already
in existence in Sections 115 and 116 of the Public
Health (London) Act, 1891, to the purposes of this
Act.
