6. Every person who, for the purpose of depositing a body in the
Mortuary, uses a shell which has not been provided by the Council
shall, in every case where the body is transferred from the shell
before being carried from the Mortuary premises to place of
burial, cause the shell, as soon as conveniently may be after the
transfer of the body therefrom, to be removed from the premises,
except when the shell has contained the body of one who has died
of an infectious disease, when the certificate of the Medical
Officer of Health, that the shell has been effectually disinfected,
shall be obtained before it is removed.
7. Every person who shall offend against any of the foregoing bye-laws
shall be liable for every such offence to a penalty of Five Pounds,
and in the case of a continuing offence to a further penalty of
Forty Shillings for each day after written notice of the offence
from the Council.
Provided, nevertheless, that the A ustices or Court before whom
any complaint may be made or any proceedings may be taken in
respect of any such offence may, if they think tit, adjudge the payment,
as a penalty, of any sum less than the full amount of the
penalty imposed by this Bye-law.
Repeal.
From and after the date of the allowance of these Bye-laws,
the Bye-laws made on the 25th day of October, 1895, by the Vestry
of the Parish of St. Luke, for the management of their Mortuary,
and allowed by the Local Government Board on the 17th day of
December in the same year, shall be repealed.
