At an early period of the proceedings, Mr. R. M.
Holborn, of Highbury Crescent, made the munificent
offer of .£300 in cash, and a like amount in
books, to the Parish if the Libraries' Act were
adopted; and Captain Penton, M.P., followed
with a similar offer, and to these gentlemen the
Vestry voted their cordial thanks for their
assistance in the success of the poll.
Objection was, however, taken to the proceedings
by certain parishioners, and on the Vestry
appointing Commissioners in accordance with the
Act, an action was commenced in the Queen's
Bench Division to set aside the poll. A rule nisi
was obtained on the loth February against the
Commissioners to show cause why a quo warranto
should not be issued to shew their authority for
exercising the office of Commissioners, on the
following grounds :—
1. That the Vestry and Guardians or Governors
of the Poor of the Parish (who respectivey
make and collect the poor rate) were not the
prescribed local authority for taking the poll.
2. That a voting paper was not issued to each
ratepayer.
3. That the papers issued were not properly
collected.
4. That a scrutiny of the votes had been refused,
though lawfully demanded.
