Quarter Sessions under the Highway Act, 1835, for the
stopping up or diversion of the portion of Pond Yard
referred to, and the giving and issuing of all necessary
notices, advertisements, &c., in connection with the same,
be made and done by Mr. Fortescue at his own expense,
costs and charges in all respects.
3. That Mr. Fortescue obtain, at his own expense, costs,
and charges, all necessary permissions from the owners of
and other persons interested in the properties adjoining or
contiguous to Pond Yard aforesaid.
4. That all conveyances, deeds of exchange, and other
legal documents that may be necessary for giving effect to
the arrangements proposed, be prepared and executed at
the expense, costs, and charges of Mr. Fortescue, in all
respects whatsoever.
5. That Mr. Fortescue hold the Board harmless against
all actions, suits, and other proceedings arising out of, or
resulting from the stopping up, diversion, or discontinuance
of the way through Pond Yard aforesaid.
6. That Mr. Fortescue, at his own expense, properly
pave, curb, channel, and drain with materials to be approved
by the Board, the new street or way so to be formed as
aforesaid, and carry out the same under the direction and
to the satisfaction of the Surveyor of the Board."
The above proposals having been assented to by Messrs.
Hughes on behalf of their client, the matter was placed in the
hands of Mr. Topham, the Solicitor of the Board, to carry out.
Subsequently Messrs. Hughes suggested an alternative scheme
for giving up, in lieu of the piece of land above referred
to, two other pieces of land at the rear of No. 27, Emerson
Street, and the adjoining houses which was thought to be
preferable in view of the possible widening of Skin Market
Place and the new thoroughfare at some future time, and an
agreement embodying the terms of the arrangement thus
modified has been entered into. The consent, however, of the
London County Council and of the Court of Quarter Sessions
will have to be obtained before the arrangement can be carried
out. Application has been made to the County Council and
plans lodged with them accordingly.
