Section 3.
A double set of notices is necessary, as a written
ntimation of the existence of a nuisance must now
be sent to the owner of the property immediately on
The Inspector becoming aware of the nuisance.
Section 4.
This intimation is not a legal "notice,'' and pro-.
beedings cannot be grounded upon it. The matter
must first be reported to the Sanitary Authority, and
they only can direct the issue of a "statutory notice."
Section 5.
Legal proceedings to obtain " orders " are similar to
those under the the old acts. A nuisance order may be
an abatement order, a prohibition order, or a closing
order, or a combination of such orders, and a penalty of
£20 may be inflicted when a closing order is made.
Section 4(4).
In addition to the order, the Justices may now inflict
a penalty for disobedience to the statutory notice of the
Vestry, but so far, the Magistrates at Worship Street
have declined to exercise this power.
Section 23.(5)
The police are relieved of the duty of looking after
smoking factory chimneys, and it is now compulsory on
the Sanitary Authorities to take steps for the abatement
of nuisances arising from smoke, and fines will only be
recoverable under the direction of a Sanitary Authority.
Section 25.
Workshops and bakehouses are placed under the
supervision of the Sanitary Authority, to the exclusion
of H. M. Factory Inspectors (except in case of default
by Sanitary Authority).Section 26.
Power is also given to compel
separate W.C. accommodation for persons of each sex in
workshops and factories.
Section 38.
The size of the building and the number of workj
people employed have nothing to do with the distinction
between factories and workshops. All works in which •
"power" (gas, steam, or water,) is used to drive the
machinery, are "factories," and their sanitary condition,
&c., is under the supervision of H.M. Factory
Inspectors. In addition to these, certain named trades,
