whose landlords were rated instead of occupiers, and that the opinion of counsel on that
point be acted upon."
The amendment on being put was carried, and on being put as a substantive motion
was also carried, and it was resolved accordingly.
The public meeting was held, and after a show of hands was taken a
poll was demanded by nine ratepayers, but the chairman refused to grant
a poll. The Clerk advised the Vestry that the resolution determining to
adopt the Acts, purporting to have been passed at the public meeting,
was, in consequence of a poll being refused, invalid, and could not be
acted upon, and that the Vestry should refuse to act upon it. The
Vestry thereupon refused to act upon the alleged resolution.
A rule Nisi calling on the Vestry to shew cause why a mandamus
should not be issued commanding them to carry out the resolution has
been obtained, and the Clerk has been instructed to shew cause.

The premises in Wheeler Street belonging to the Vestry having been

of the late tenant, have instructed the clerk to give her notice
to quit at Lady-day, 1876.
