Action Taken.
(a) Thyme, dried (1912, informal). Case remnants of insect
pupa were found on the top flap of the carton containing
this article. No infestation of the article itself was
detected, but it was of poor quality in respect of aroma
and flavour. There was no further stock at the retailer's
premises and no action was possible.
(b) Jelly crystals (1934, informal and 1951, formal). Sample
No. 1934 contained only 80.1% sugar, also the label did
not specify the ingredients in the order of the proportion
in which they were used. Subsequent formal sample (1951)
contained only 75% sugar. Proceedings were taken against
the manufacturers, who were fined £2 2s. Od. for the
labelling offence, £5 5s. Od. for the sugar deficiency, and
ordered to pay £5 5s. Od. costs.
(c) Orange Juice (1935, informal). Contained an excessive
amount of tin—2.8 grains per pound. A subsequent formal
sample proved to be genuine.
(d) Pork Chipolata. Sausages (1938, informal). Contained 62%
meat, including fat, instead of 65%. A subsequent formal
sample proved to be genuine.
(e) Yorkshire Pudding Mixture (1942, informal). Infestation
by cereal psocids. Remainder of stock surrendered and
destroyed.
(f) Fruit salad in syrup (1954, informal). Fruits not specified
on the label in order of their proportion. This question
was taken up with the packers informally. The taking of
a formal sample was impracticable owing to the nature
of the sample.
(g) Butter-blended margarine (2018, informal, 2019 formal).
Contained no butter. Retailer was fined £2, with £1 1s. Od.
costs for selling butter blended margarine not of the substance
demanded, and £1 with £1 1s. Od. costs for displaying
an advertisement regarding butter blended margarine
without stating the percentage of butter which it contained.
The defendant stated he was misled by the label
having the letters B.B.M. which he assumed, erroneously,
referred to Butter Blended Margarine.
(h) Beef sausages (2021 informal, 2060 formal). Sample No.
2021 contained only 42% meat and 2060 contained 45%
meat, instead of 50%. Proposed Court proceedings were
dropped as production of warranty by the retailer
appeared to be a good defence.
