Prosecutions
Public Health Act, 1936, S. 93 Legal proceedings to secure abatement of
nuisances were taken in nine cases. In six cases summonses were withdrawn
and costs totalling £14.14. 0d were awarded no costs were awarded in the
seventh case. In the eighth case the owner of a private dwelling failed to
comply with an abatement notice served upon him. A summons was issued and
eventually the owner appeared before the court when an order was made for the
work to be carried out within 42 days and he was required to pay £2.2.0d
costs. He failed to comply with the justices order, a further summons was
issued and the defendant in his absence was fined £2.0.0d and costs of £2.2.0d
were awarded. He again failed to comply and a further summons was before the
court when a daily penalty of five shillings was imposed in respect of each
of the 60 days he had failed to comply with the court order since conviction
and costs of £2.2.0d were awarded. The work was eventually completed in
default. The ninth case was of failure to comply with an abatement order
giving rise to a continuing smoke nuisance; there was a fine of £10. 0.0d and
£5.5.0d costs were awarded.
