Result of Service of Notices.
(a) Legal proceedings.
(1) Public Health Act, 1936.
Legal proceedings were instituted against an owner for failing to
comply with an Abatement Notice. At the first hearing the case was
adjourned at the request of the Bench so that further evidence could be
obtained. As the result of a further inspection in order to obtain the
additional evidence, it was found that the work which had been executed
was such that the case could not be proceeded with. The summons was
therefore withdrawn.
(2) Housing Act 1936.
Notices were served under Section 9 of the Housing Act, 1936 upon
the owner of seven dwelling houses requiring him to make them in all
respects fit for human habitation. The owner appealed under Section
15(1) (a) of the Act on the grounds that:—
(i) The houses were unfit for human habitation on account of age
and inconvenience and inadequate accommodation by modern
standards.
(ii) They were incapable at reasonable expense of being rendered
fit, and
(iii) The carrying out of the repairs required by the Notices would
still leave them unfit.
The case was heard at Kingston County Court and during the
course of the hearing the Judge was taken to see the dwelling houses.
