As only one of the above samples complied with the Sale of Milk Regulations,
no action was taken against the vendor. Sample B 126, which was 5.3
per cent, deficient in solids-not-fat, gave a freezing point within the range
shown by genuine milk, confirming the fact that the deficiency of solids-notfat
was due to natural causes. Sample B 129 shows an unusual combination
of figures, the solids-not-fat being the legal minimum and the freezing point
"being at the extreme end of the range. About 6 per cent, of water could be
added to such a sample and though this would cause a deficiency in solids-notfat,
the freezing point would still be within the range shown by genuine milk.
Samples C 264 and C 266. Both these samples were cowshed samples, deficient
in fat and the summonses were dismissed, as it was proved that the milk
had not been touched after leaving the cowshed.
In three cases comprising 12 samples, legal proceedings were taken on
the result of the freezing point determination, though the percentage of
solids-not-fat satisfied the requirements of the Regulations.
The cases were heard by three different magistrates and in each case the
magistrate accepted my evidence with regard to the freezing point. One
case was dismissed. The cases were :—
(1) B 167. At least 1.5 per cent, of added water (Hortvet). A
conviction was obtained.
(2) C 811. At least 1.9 per cent, of added water (Hortvet).
Summons dismissed as it was stated that the amount of added
water was trivial.
(3) This case was concerned with 10 samples taken from four vendors.
It was agreed that all the summonses should be dealt with as
one and sample C 782, containing at least 1.9 per cent, of added
water (Hortvet), was chosen to decide all the cases. This
vendor was convicted. The other summonses were then dealt
with as follows :—
C 325, C 364, C 794 and C 795. These samples contained
at least 1.1, 4.2, 2.5 and 4.3 per cent, of added water (Hortvet)
respectively. C 325 and C 364 were withdrawn, C 795 was not
separately dealt with, and in connection with C 794 the vendor
was fined and removed from the register. C 781, C 807, C 80S,
C S09. These samples contained at least 6.4, 2.8, 2.6 and 2.3
per cent, of added water (Hortvet) respectively. The vendor
was fined in each case. C 781 was also deficient in solids-notfat
to the extend of 2.4 per cent., and the defence forwarded
the third part to the Government chemist, who confirmed my
analysis, the certificate showing a deficiency of 3.0 per cent.
Sample B 717 contained at least 1.5 per cent, of added water
(Hortvet). The vendor was fined.
Sample 72 N, not included in Table D, taken in the Borough
of Hackney, contained at least 0.9 per cent, added water
(Hortvet). Ordinarily this sample would have been reported
as suspicious but as the sample was taken in connection with a
retailer in this Borough, it was reported as "containing a small
percentage of added water, possibly as little as 0.9 per cent."
The vendor was cautioned.
