The samples K 4 and N 5 were obtained from the same vendor and legal
proceedings were taken. At the first hearing of the case the Magistrate
wished to dismiss both summonses as he considered that if there were any
adulteration it was so minute as not to count. At the suggestion of the
Council's Solicitor the case was adjourned for the Analyst's Certificate to be
explained. A second hearing was adjourned owing to the indisposition of
the Magistrate, and at the third hearing the defendant's solicitor requested
that both samples should be sent to Somerset House for analysis, the case
again being adjourned. At the fourth hearing it was shown that the Somerset
House analyses confirmed the adulteration of the samples. The defendant
then produced a Warranty and the Magistrate dismissed the summonses as
the Warranty was proved. This was the sixth occasion upon which summonses
against the defendant for selling adulterated milk had been dismissed
on production of the Warranty.
