4. NATIONAL ASSISTANCE ACTS — COMPULSORY
REMOVAL. Power is given to the Medical Officer of Health to
make application to a Magistrate, if necessary ex parte, for the
compulsory removal of any person who is suffering from a grave or
chronic disease and is not obtaining or is not able to give to himself
the care and attention necessary to his condition.
During the very severe weather of the first months of this year
conditions deteriorated in the homes of many elderly persons and it
was necessary to invoke the use of this legislation for two compulsory
removals-one man and one woman.
This action is described in the Annual Report, as the compulsory
removal of an individual from his home is undertaken only in dire
emergency and calls for recognition of the fact that the action is,
although directed to the welfare of the person involved, none the less
arbitrary and oppressive.
