Certificates of Disrepair.
Under the Housing Repairs and Rents Act, 1954, a further duty
has fallen to this department of reporting upon applications for
Certificates of Disrepair in cases thought by the tenant of a house to
justify disallowing increase of rent sought by the landlord. Experience
of this particular matter is naturally lacking to a considerable extent
and apart from any other factors the Courts will undoubtedly in due
course throw light upon many points which may at the moment appear
indefinite. Even at this early stage, however, it is clear that difficulties
of interpretation will arise in some cases and in many the degree of
disrepair is of a minimum order. Up to the end of the year we had
submitted to us some 11 applications and of these the certificates sought
were issued in 6 and refused in 5. The period covered represents only
some 4 months during which the Act was in operation and the coming
year will doubtless see the numbers noted greatly augmented.
