Legal Proceedings under Public Health Act, 1936, Section 94,
During the year it was found necessary to institute legal proceedings in two cases for the
abatement of nuisances.
One case arose from the keeping of cats, and the Magistrates granted an Order for the abatement
of the nuisance within seven days and awarded the Council £5.5.0. costs. It was also necessary
in this case for a Warrant of Entry to be applied for by the Public Health Inspector.
The other case arose from failure to comply with an Abatement Notice requiring the carrying
out of repairs and although the work was executed shortly before the Hearing, the case was proceeded
with and the Magistrates awarded the Council £3.3.0. costs.
HOUSING ACT, 1957
During the year under review 34 houses were dealt with under the Housing Act, 1957, involving
the making of 4 Demolition Orders and 30 Closing Orders.
Certificates of Unfitness were issued under the Housing Subsidies Act, 1956 in respect of 22
houses in the Council's ownership.
Of the 56 houses, 23 were actually closed during the year, and 4 were demolished.
In addition, 48 houses were closed and 11 demolished in respect of which Closing or Demolition
Orders had been made or Certificates of Unfitness issued prior to 1958.
During 1958, 89 families involving 297 persons were displaced from unfit properties, 82
families involving 281 persons being rehoused by the Council and 7 families involving 16 persons
being rehoused by other authorities or finding their own accommodation.
The steady progress already made in dealing with the unfit houses listed in the survey of
the Borough carried out under the Housing Repairs and Rents Act, 1954, was maintained throughout
the year and very few houses now remain to be dealt with outside the areas defined by the Council
as being in need of redevelopment.
