D (17) The Rent Act 1957
Action under the Act is enumerated below:—
(1) Number of Applications for Certificates of
disrepair 7
(2) Number of Certificates issued 0
(3) Number of Revocations applied for 1
(4) Number of Revocations granted 1
No appeals, either by landlords or by tenants, against
Local Authority decisions were made to the County Court
during the year.
The majority of enquiries made with regard to this Act
are from tenants desirous of effecting rent reductions because
of items of disrepair, but considerable assistance has been
given to those seeking information on matters concerning
de-control, notice to quit, and tenancy agreements. Having
regard to the circumstances, each case is dealt with on its
merits.
In one instance it was found that the rent limit of a
controlled house had been exceeded and that the tenant had
overpaid rent by £32. In this case negotiations with the owner
resulted in an immediate reimbursement of £10 in cash to
the tenant, together with provision for a period of 22 weeks
free rental, and to comply with the provisions of Section 1
and the Sixth Schedule, the rent was reduced to twice gross
value.
