Samples of a mineral water "soft drink," made by dissolving
tablets in water with the addition of carbonic acid gas proved to be
adulterated, being deficient in sugar and saccharine content. This drink
was however sold and consumed on the premises where it was prepared,
and in these circumstances no offence was committed, the legal standard
not being applicable to such a sale. The drink was retailed at one
penny per bottle, and was quite harmless to the consumer. Its price
certainly did not indicate nutritive value. It is worthy of note, however,
that had the drink been sold for consumption off the premises where it
was made and vended, an offence against statute would have been
committed and legal proceedings would have been instituted. This
appears to be an instance where Mr. Bumble's remarks on the law are
completely justified.
