Upon receiving the amendments proposed by the Borough Council the Local
Government Board suggested a Conference to discuss the proposed amendments.
The Conference took place at the Board's Offices in Whitehall on the 27th
September. After discussion it was agreed with regard to (c) —
(e) That the following addition be made to the existing By-law 3 of
the Council's By-laws:—
"Provided that in either of the following cases a tenement
house shall be exempt from the operation of these Bylaws
; that is to say:—
"(1) Where the landlord resides upon the premises
and the sub-letting is not to more than one
tenant.
"(2) Where the number of separate dwellings in
which the house is sub-let does not exceed onethird
of the total number of habitable rooms in
the house and no such dwelling contains less
than two habitable rooms."
The paragraph dealing with the registration of tenement houses where an
underground room was found to be illegally occupied was deleted, the inference
being that such a house would not come within the exemption.
With regard to the new by-laws (a) and (6) approved by the Council on the
26th June, 1907, these By-laws being derived from the Model By-laws, the
Local Government Board further suggested that it was desirable that the
Borough Council should adopt the entire draft Model By-laws of the Board,
forwarded for consideration on the 20th July, 1907, and embody the foregoing
additional By-law C, as amended, in substitution for the present Tenement
House By-laws of the Council.
This amended addition to By-law 3 as an exemption clause was adopted by
the Borough Council on the 9th October, and sent to the Local Government
Board for approval.
On the 19th February, 1908, I reported to the Public Health Committee as
follows:—
I have enquired into the subject matter of the letter of the Local
Government Board, dated 29th October, 1907 (119, 427 C 1907), enclosing
copy of a letter of the County Council, dated 7th October, 1907, relative to
the Exemption Clause proposed as one of the amendments of the By-laws
with respect to Houses Let in Lodgings, together with a copy of a list of houses
showing the effect of the Exemption Clause.
The Exemption Clause as adopted by the Borough Council on the 9th
October, 1907, is as follows:—
Addition to By-law 3:—
That, in substitution of the addition to the By-laws agreed to be
made by the Council on the 26th June, 1907, the following
