(a) The works required.
(b) The time (not less than 21 days) within which the work is to
be executed.
(c) The view of the authority that those works will render the house
fit for human habitation.
Copies of this notice may be served on any other person having an
interest in the house, e.g. as freeholder, mortgagee, or lessee.
In case of default the local authority may execute the works and
recover any expenses incurred by action or summarily as a civil debt or
by declaration that such expenses be payable with interest by weekly or
other instalments within a period not exceeding 30 years.
Where, on appeal against the notice, the judge has found that the
house cannot be made fit at reasonable expense, the local authority may
purchase the house by agreement or by compulsory purchase order and
if the house is purchased compulsorily the authority must themselves
carry out the works specified in the notice.
It should be noted that in determining whether a house can be made
fit at a reasonable expense, regard must be had to the estimated cost of
repairs and to the value the house will have when the works are
completed.
Section 25 — Clearance Areas
This Section enacts that before declaring an area to be a clearance
area, the local authority must be satisfied that the area concerned is one
which all the dwelling houses are:
(a) unfit for human habitation by reason of disrepair or sanitary
defects;
(b) dangerous or injurious to the health of the inhabitants of the area
owing to their bad arrangement or the narrowness or bad
arrangement of the streets, and that any other buildings, if any,
which are included in the area are for the like reason dangerous
or injurious to health; and
(c) that the most satisfactory method of dealing with the conditions
in the area is the demolition of all the buildings therein.
The authority must also satisfy themselves that:
(i) they can provide or secure the provision by means of other
agencies of such rehousing accommodation as may be required
in advance of displacements of persons from that area;
(ii) their resources are sufficient.
