The Defendant gave evidence and called a witness to show that the small parcel on the counter in respect of which he was summoned w as a traveller's sample, and was not in. tended for sale. The traveller bore this statement out, and as the only margarine in the shop was this small packet of a pound or so weight, the Magistrate thought the explanation given was reasonable. The Defendant in this case supplied the " butter " in the No. 294 N. case.
