The man to whom the milk was consigned said that he paid nothing for the milk and
wa3 quite satisfied with it. It appeared that he supplied the Defendant with fish in
exchange for milk, and as he did not complain of his fish, he would not complain if the
milk was thin. The Magistrate thought that this was not a sale that was contemplated by
the Act; it was only a matter of barter, and he felt obliged to dismiss the summons.

The Consignee expressed himself very satisfied with the quality of the milk hitherto
supplied, and the Defendant attributed the deficiency to natural causes, stating that
this was the first complaint in twenty-five years. The Magistrate expressed himself satisfied
with the Defendant's version, and the summons was therefore withdrawn.

The Defendant had a warranty, but owing to the summons having been served whilst
he was away on his holiday he failed to give notice in time. The Magistrate took this
