Resolved—That the word "chimney" in Section 24 (b) of the
Public Health (London) Act, 1891, should be deemed to include—
(i.) Openings through which smoke is emitted from
buildings or places in which processes of manufacture are
carried on, and the chimneys of any building or place where
furnaces are used in operations carried on under statutory
powers.
(ii.) The chimneys of any Government workshop or
factory.
Resolved—That in special cases of nuisance arising under
Sections 23 and 24 of the Public Health (London) Act, 1891, the
proceedings in respect of any nuisance may, at the request of, and
by agreement with the Sanitary Authority, be taken by the London
County Council in such special cases.
The Public Health and Housing Committee recommended the Council
that the recommendations of the Conference be approved and supported.
London County Council (General Powers) Bill, 1910. Part
IV.—Smoke Nuisance.
Section 20 amends the Public Health (London) Act, 1891, by deleting
the word "black" in Section 24, under which any chimney (other than of
a dwelling house) sending forth black smoke in such quantity as to be a
nuisance may be dealt with by prosecution of the persons responsible.
Section 24 is also extended to include factories owned or used by the
Crown and places in which any process is carried on under statutory
powers, and the word "chimney" is to include any opening through
which smoke is emitted.
Section 21 enables the London County Council, at the request of the
Borough Council, to enforce the provisions of Section 23 of the Public
Health (London) Act, requiring that furnaces and steam vessels shall
consume their own smoke, and gives power to the London County Council
to enforce the provisions of the Public Health (London) Act, with reference
to smoke nuisance in cases where cause of nuisance arises outside the
county and in cases where it arises on premises of a Metropolitan Borough
Council.
