Under date 15th April a letter was received from the London
County Council referring to their previous circular letter. The
letter stated that this proposal was made on account of resolutions
adopted by the Conference of London Sanitary Authorities held
at the County Hall on the 29th June and 7th November, 1900.
From replies received to the circular letter oh the 27th February,
1903, it appeared that a large number of Sanitary Authorities were
bpposed to the proposal that it should be their duty to
collect trade refuse, and with a view of meeting their objection,
clauses had been re-drafted so as to enable, but not to compel
Sanitary Authorities to undertake any such collection.
The Public Health and Housing Committee considered it
desirable Borough Councils should have power to arrange for the
systematic removal of offensive trade refuse, and recommended the
Council to approve these suggested clauses of the London County
Council, which were as follows:—
The Sanitary Authority if they think fit may:—
1. (a) Employ a sufficient number of scavengers, or contract
with any scavengers, whether a company or individuals, for collecting
and removing at proper periods, of which sufficient notice shall
be given, all trade refuse of an offensive or noxious nature from
any premises within their district.
(b) Where the Sanitary Authority, in pursuance of the power
hereby conferred, has undertaken the collection of such refuse and
such refuse is not removed from any premises in the district at the
period so fixed as aforesaid, and the owner or occupier serves on
the Sanitary Authority a written notice requiring removal of such
refuse, the Sanitary Authority shall comply with such notice within
48 hours after that service, exclusive of Sundays and public holidays.
If a Sanitary Authority fail without reasonable cause to
comply with such notice they shall be liable on conviction by a
court of summary jurisdiction to a fine not exceeding twenty pounds.
